Colorado hospital charity care
State rules
Colorado's Hospital Discounted Care law (C.R.S. 25.5-3-501 to 507, from HB 21-1198 and later bills) covers general hospitals, freestanding emergency departments and licensed outpatient departments, plus critical access hospitals from July 1, 2026. A qualified patient lives in Colorado, has household income at or below 250% FPL, and received hospital care; the state health care agency (HCPF) says this applies even with insurance and regardless of citizenship or immigration status. Since September 1, 2022, facilities must screen every uninsured patient (unless the patient declines) for Medicaid, CHP+, Medicare, emergency Medicaid and discounted care, using the state's uniform application; insured patients are screened if they ask. HCPF says screening must happen within 45 days of care and the hospital must decide within 21 days of the application. This is a cap on the bill, not free care: charges are limited to HCPF's discounted rates, which approximate and are not less than the greater of the Medicare rate or 100% of the Medicaid base rate. Monthly payments may not exceed 4% of monthly household income for a facility bill, 2% for each licensed health care professional, or 6% for a combined bill, and after 36 months of payments the bill counts as paid in full. The income method must not consider assets. A facility may not deny discounted care because the patient has not applied for public coverage (unless the patient is presumptively eligible for Medicaid). Before sending a bill to collections or taking an extraordinary collection action, the facility must have screened the patient, applied the discount, explained the bill in plain language and billed any insurance; HCPF says patients get written notice 30 days before collections. Appeals go to the hospital in writing within 30 days, then to HCPF within 15 calendar days of the hospital's decision. HCPF takes complaints (303-866-2580, hcpf_HospDiscountCare@state.co.us) and can fine a facility up to $5,000, or $5,000 per week if it does not take corrective action. Each hospital's own financial assistance policy can be more generous, for example free care. Nonprofit hospitals also follow federal IRS 501(r).
