Oregon hospital charity care

State rules

Every Oregon hospital must have a written financial assistance policy (ORS 442.610). For nonprofit hospitals and their nonprofit clinics, the policy must at least give 100% off patient costs at or below 200% FPL, 75% off at 201-300%, 50% off at 301-350% and 25% off at 351-400% (ORS 442.614, from HB 3076 of 2019), cover all medically necessary care, and not require a Medicaid application first. For Oregon residents, a nonprofit hospital's application may require only household income and information about other payers (such as insurance or a car crash claim); anything else, including assets, must be marked optional and cannot be used to deny help, though hospitals may still collect what federal Medicare cost reporting requires (ORS 442.610). Since July 1, 2024 (ORS 442.615, from HB 3320 of 2023), hospitals must screen patients who are uninsured, on state medical assistance, or owe more than a set amount for presumptive eligibility before sending a bill, without asking for documents and without hurting credit. 2026 HB 4040 (Oregon Laws 2026, chapter 109) raised that amount from $500 to $1,500 for a single hospital encounter. Patients can still apply if not screened, if they disagree with the result, or up to 12 months after paying, and get a refund if they were eligible (with interest if the hospital wrongly denied them). Approval based on documents lasts 9 months. Hospitals must have a written appeal process and must pause collections during an appeal. The Oregon Health Authority (OHA) sets screening and appeal rules and posts a patient notice. Nonprofit hospitals also follow federal IRS 501(r).

Status: summarized from ORS chapter 442 on oregonlegislature.gov, enrolled 2026 HB 4040 and the OHA patient notice, checked Oct 23, 2026; not confirmed by a lawyer or agency. The ORS page still showed $500 on Oct 23, 2026; HB 4040 took effect when signed (exact signing date not confirmed).
