California hospital charity care

State rules

California's Hospital Fair Pricing Policies (Health and Safety Code 127400 and following) apply to every general acute care hospital, nonprofit or not. A "financially qualified patient" is uninsured or has high medical costs (out-of-pocket costs over 10% of family income) and has family income at or below 400% FPL. Each hospital must have a written charity care policy and a discount payment policy for these patients. The law does not set a free-care income level, so each hospital picks its own split between free and discounted care. Under a discount, the hospital may not expect more than the greater of what Medicare or Medi-Cal would pay. Hospitals may not consider a patient's monetary assets (the only exception is waiving Medicare cost sharing, and retirement plans are still excluded). Income proof is limited to recent pay stubs or tax returns, there is no deadline to apply, and payment plans must be interest-free. Hospitals may not report patients to credit agencies, sue before 180 days, garnish wages, or place liens on a home. Policies are filed with the Department of Health Care Access and Information (HCAI), which has handled enforcement and patient complaints since January 1, 2024 (AB 1020), with penalties up to $40,000. From July 1, 2027 (AB 1312), hospitals must presume eligibility for patients on programs such as CalFresh or CalWORKs, or who are homeless. Emergency physicians must also give discounts at or below 400% FPL (127452). Nonprofit hospitals also follow federal IRS 501(r).

Status: summarized from the statute text on leginfo.legislature.ca.gov and HCAI pages, checked Oct 23, 2026; not confirmed by a lawyer or agency.
