How to choose and apply for hospital charity care

Written 2026-11-02. Sources linked. Not legal advice.

1. You usually apply at the hospital that treated you

Charity care is set by each hospital's financial assistance policy. Nonprofit hospitals must have a written policy under federal 501(r) rules.

2. Check your state's floor

Some states set minimums. Washington (RCW 70.170.060) and Oregon (ORS 442.614) set free care levels by income. Colorado caps bills for residents at or below 250% of poverty guidelines (HCPF). See each state page.

3. Work out your poverty level percentage

Use the poverty guidelines page with your household size and income.

4. Compare policies if you have a choice

For planned care, compare the free care and discount levels and whether the hospital counts assets. Each hospital page here links to the policy PDF.

5. Apply even after you get a bill

Ask the billing office for the application and keep copies. In California, you can file a complaint with HCAI if you were denied assistance (source).
